FAILURE TO COMPLY WITH THE LAW

Non-compliance with some Acts can attract penalties and even prison sentences.

Below is a list of some Acts that affect business in SA. Non-compliance with any of these Acts can:
  • Attract penalties ranging from fines to imprisonment for 10 years plus a monetary fine
  • Make the members of Close Corporations or the company personally liable for the debt of the Close Corporation

  • The responsibility for compliance rests solely with Management. In the case of:
  • A Close Corporation - the members
  • A Company - the directors and public officer


  • Reporting of irregularities Accounting Officers (in the case of Close Corporations) and Auditors (in the case of Companies) have a duty by law to report certain offences and/or qualify the accounting officers report (Close Corporations) or the Audit Report (Companies).



    HOW TO ASCERTAIN IF YOUR CURRENT B-BBEE CERTIFICATE IS VALID

    SANAS CERTIFICATE REQUIREMENTS AS PER THE R47-02
    A. The name and identifiable physical location(s) of the measured entity B. The registration and VAT number of the measured entity
    C. The dates of granting of the B-BBEE score and the period of validity D. The expiry date of the Verification Certificate
    E. A unique identification number F. The standard and/or normative document, including the issue and/or revision used to evaluate the client
    G. The name and/or mark/logo of the B-BBEE Verification Agency H. The scorecard against which the measured entity has been verified
    I. The broad-based B-BBEE status level J. The SANAS logo on the Verification Certificate
    K. The B-BBEE procurement recognition level L. The overall B-BBEE status level as well as the B-BBEE status level of each of the seven elements
    M. Certificate must be signed
